Magistration: the first 24–48 hours
Everyone arrested in Dallas County sees a magistrate, typically within 24 to 48 hours. The magistrate informs you of the charge, advises you of your rights, and sets a bond amount and conditions. For a standard first-offense DWI, many arrestees qualify for a personal recognizance (PR) bond or a modest surety bond; repeat offenses, high BAC, accidents, and child passengers push amounts up and add conditions.
Bond conditions are the part people underestimate
Dallas County DWI bonds commonly include conditions beyond money: no alcohol consumption, random testing, and — increasingly standard for BAC 0.15+ or repeat cases — an ignition interlock or alcohol-monitoring device installed as a condition of release. Violating a bond condition can get the bond revoked and put you back in custody weeks before trial.
Bond reduction hearings
If the amount or conditions are unworkable, an attorney can request a bond-reduction hearing, arguing ties to the community, work obligations, and the specifics of the case. These hearings are routine in Dallas County and often happen within days of hiring counsel.
Using a bondsman vs. a PR bond
A surety bond through a bondsman typically costs a nonrefundable percentage of the bond amount. A PR bond costs little or nothing upfront but requires approval. Either way: read every condition on your bond paperwork, calendar every court date, and treat the 15-day ALR deadline as its own separate emergency — bond handles the criminal case, not your license.
